Withdrawal Policy for Consumers

(A “consumer” is any natural person who concludes a legal transaction for purposes that are predominantly not attributable to their commercial or self-employed professional activity.)

Right of Withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period is 14 days from the day:

– on which you or a third party nominated by you, other than the carrier, took possession of the goods, if you ordered one or more goods as part of a single order and they are delivered together;

– on which you or a third party nominated by you, other than the carrier, took possession of the last good, if you ordered multiple goods as part of a single order and they are delivered separately;

– on which you or a third party nominated by you, other than the carrier, took possession of the first good, if goods are delivered regularly over a defined period (subscription).

To exercise your right of withdrawal, you must inform us (nōuxx GmbH, Kollwitzstr. 76, 10435 Berlin, Germany, Telephone: +491705031010, Email: hello@nouxx.com) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or an email). You may use the model withdrawal form below, but this is not mandatory.

To comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the withdrawal period expires.

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse all payments we received from you, including delivery costs (with the exception of additional costs arising from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and no later than 14 days from the day on which we received the notification of your withdrawal from this contract.

We shall use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you. You will not be charged any fees for this reimbursement.

We may withhold reimbursement until we have received the goods back or until you have supplied evidence of having sent the goods back, whichever is earlier.

You shall return or hand over the goods to us without undue delay and in any event no later than 14 days from the day on which you notify us of the withdrawal from this contract. The deadline is met if you send the goods before the 14-day period expires.

You bear the direct costs of returning the goods.

You shall only be liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

Exclusion and Expiry of the Right of Withdrawal

The right of withdrawal does not apply to contracts for:

– the delivery of goods that are not prefabricated and for the production of which an individual selection or determination by the consumer is decisive, or which are clearly tailored to the personal requirements of the consumer;

– the delivery of goods that can spoil quickly or whose expiry date would be quickly exceeded;

– the delivery of alcoholic beverages, the price of which was agreed upon at the time of the conclusion of the contract, but which can be delivered no earlier than 30 days after the conclusion of the contract and whose current value depends on fluctuations in the market over which we have no influence;

– the delivery of newspapers, periodicals, or magazines, with the exception of subscription contracts.

The right of withdrawal expires prematurely for contracts involving:

– the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene if the seal has been removed after delivery;

– the delivery of goods that, due to their nature, have been inseparably mixed with other goods after delivery;

– the delivery of audio or video recordings or computer software in sealed packaging if the seal has been removed after delivery.
